Description

Objective:

The course objective is to describe the American legal system in general and as it applies in particular to employment-related issues; explain fundamental rules of law related to employment relationships, particularly discrimination law, labor law, contract law, the Family Medical Leave Act, the Fair Labor Standards Act, and the principle of respondeat superior; appreciate the extent to which legal requirements affect employment relationships and decision making in the nonprofit sector; and enhance critical thinking and problem-solving skills by applying principles of law to diverse employment situations in weekly web and chat room discussions and on examinations.

Learning Outcomes:

  • Explain jurisdiction and basic court structure and procedures
  • Identify antidiscrimination statutes and the seven federal classifications
  • Understand the role of the EEOC and typical court proceedings for discrimination cases
  • Describe the issue remedies and enforcement of both the FMLA and the FLSA
  • Identify best practices and risk management for tort law
  • Recognize legal issues surrounding benefits, privacy, and employee termination
  • Describe the legal aspects surrounding different employment relationships
  • Define various discrimination issues and how to prevent them
  • Explain the rights and duties of employers, employees, and labor organizations under federal labor law
  • Assess whether a nonprofit organization will face tort liability
  • Summarize the purpose for and process of an employment practices audit
