Comments to the Department of Education on Proposed Rule Amending Title IX Regulations

January 30, 2019

ACE and 61 other higher education associations submitted comments Jan. 30 on the Department of Education’s notice of proposed rulemaking (NPRM) amending regulations implementing Title IX. The NPRM was published in the Nov. 29, 2018 edition of the Federal Register

The associations believe while there are some elements in the proposed regulations that would be helpful, on balance, the draft rule would do more harm than good. The comments note provisions that would help institutions address sexual harassment, provisions that would undermine these efforts, and provisions that require clarification.
