Description

Objective:

The course objective is for ISO-2s to gain additional competence in research methods, identifying fraud and completing fraud referrals, and writing legally sufficient adjudicative decisions.

Learning Outcomes:

  • Properly structure legal arguments in the IRAC format
  • Explain how rules are applied to resolve issues in cases
  • Research legal, regulatory or policy documents to support case decisions
  • Locate appropriate policy and procedural guidance in order to properly adjudicate a case and write a legally sound decision
  • Apply appropriate laws, and identify and articulate possible fraud effectively
  • Identify possible fraud, egregious public safety and national security risks
  • Complete timely case referrals to FDNS
  • Explain why a sound legal argument is important
  • Build a full legal decision, using IRAC
  • Understand the requisite burden and standard of proof in order to sustain a charge of inadmissibility or deportability in removal proceedings, determine the amount of evidence required to sustain a charge, and properly write Notice to Appear (NTA) allega
