Description

Objective:

The course objective is to master the legal foundations of the claims process, empowering students to ensure good faith claims handling and negotiate fair settlements for customers.

Learning Outcomes:

  • learn the elements of a legally binding contract, elements that might render a contract unenforceable, contract construction rules commonly used by courts to interpret contracts, how to Evaluate the circumstances in which a third party would have enforceable rights under a contract, and how to conclude a contract.
  • explore the characteristics of insurance contract, the unique characteristics of insurance contracts, determining when a third party can benefit from an insurance contract, demonstrating how representations and warranties affect the creation and voidability of an insurance contract, and how waiver, estoppel, election can cause an insurer to forfeit a coverage defense, and how nonwaiver agreements and reservation of rights letters affect insurers’ and insureds’ rights.
  • learn the procedures of civil trials, alternative dispute resolution procedures, and administrative agency procedures.
  • understand the concepts of ownership and possession of personal property, the rights and duties of the parties to a bailment, distinguish types of real property ownership, Examine the aspects of landlord-tenant law, how warehouse receipts and bills of lading are created and used, and how consumers are protected by laws.
  • gain familiarity with liability based on negligence, defenses against negligence claims, how negligence applies to landowners or occupiers of land, and how to evaluate intentional torts. become familiar with liability as a result of unique circumstances, the causes of action for products liability and the possible defenses to them, and the types of damages a court can award a plaintiff for a tort claim.
