Issue Brief: Law Firm Sues Private Universities for ERISA Violations

At least a dozen lawsuits were filed in August 2016 against private universities alleging that they had breached their fiduciary duties under the Employee Retirement Income Security Act (“ERISA”) in the way they administer their 403(b) retirement plans, causing faculty, staff and retirees to be charged excessive fees. This issue brief gives an overview of the lawsuits and advises institutions to assure that their counsel and plan fiduciaries discuss their own situations with qualified ERISA advisors as they consider what impact, if any, the suits could have on them and the retirement plans they administer.​​​​
