Amicus Brief: To the National Labor Relations Board on College Athletes and Unionization

Amicus brief submitted by ACE and four other higher education associations to the National Labor Relations Board in support of Northwestern in a case dealing with a regional director's decision to allow the university's football players to unionize.

The brief posits that students who participate in intercollegiate athletics and receive athletic scholarships are not employees and therefore not subject to the National Labor Relations Act.

Along with ACE, associations signing the brief include:

  • Association of Governing Boards of Universities and Colleges
  • Association of Public and Land-Grant Universities
  • College and University Professional Association for Human Resources
  • National Association of Independent Colleges and Universities
