Amicus Brief: University of Southern California v. National Labor Relations Board

​ACE and seven other higher education associations submitted this amicus brief to the National Labor Relations Board (NLRB) in support of University of Southern California’s appeal challenging the Board’s ruling that adjunct faculty members are eligible to form a collective bargaining unit under the National Labor Relations Act (NLRA). In a 1980 U.S. Supreme Court decision involving Yeshiva University, the court found that tenure-track faculty members are managers and therefore not covered by the NLRA. A more recent NLRB decision involving an adjunct faculty union bid at Pacific Lutheran University opened the door to potential exceptions to that notion.​
